IRS Scam Alert: Don't Be Scammed By Fake IRS Communications (Especially If You Owe Back Taxes.

If the IRS needs to get in touch with a taxpayer, they send a letter— not an email, not a phone call, and definitely not a message over social media. Especially in cases of tax fraud.

So, if you got a voicemail threatening you about issues with the tax return you filed or back taxes you owe, it’s most likely the latest IRS phone scam.

The IRS even issued a warning during tax season last year about “a new twist on an old scam” that Americans need to watch out for. It said scammers file a fake tax return with stolen personal information, like your Social Security number, and then use actual bank account information to have the refund deposited into your own account.

Then they call to collect, posing as the IRS or debt collectors demanding the return of the fraudulent tax refund. In some cases, the caller threatens criminal fraud charges, an arrest warrant, and to “blacklist” the taxpayer’s Social Security Number.

What to do if you receive an IRS scam call or a fraudulent tax refund

Never return a phone call from someone claiming to be with the IRS. Instead, individuals should call the IRS directly at 800-829-1040, and businesses should call 800-829-4933.

The US Department of Justice says the IRS never discusses personal tax issues through unsolicited emails or texts, or over social media. Always be wary if you are contacted by someone claiming to be from the IRS who says you owe money, even if you really do.

If you receive an unexpected and suspicious email from the IRS, forward it to phishing@irs.gov.

Remember these important anti-scam guidelines:

Never trust caller ID Scammers can easily exploit caller ID technology to display false identities, including law enforcement or even IRS employees.

Know how to identify red flags Are you being pressured to send money or urged to act quickly? These are common ploys used by scammers. If something feels off, trust your instinct.

In many of the most common types of general scams, you may be:

  •     Pressured to send money
  •     Threatened with law enforcement action
  •     Told to purchase gift cards and provide codes as a form of payment
  •     Asked to cash a check for a stranger
  •     Instructed to make a cash deposit for sweepstakes
  •     Offered more than you are asking for something with a request to send the overpayment elsewhere

If you provide your information or send money to a scammer, there is often little you can do to get your money back.

So, what should you do if you really do owe the IRS back taxes or have unfiled returns?

If you owe more than $10,000 (or any amount) in back taxes to the IRS and cannot afford to pay it, the absolute worst thing you can do is ignore the problem. Penalties (fines) and interest will add up quickly.

Keep ignoring the IRS and they will get your attention, as they have the power to garnish your wages and freeze or seize your bank accounts. Most people do not want to deal with the IRS themselves and for good reason: the outcome is usually not in their favor.

WHAT DO YOU DO WHEN YOU RECEIVE A NOTICE FROM THE IRS TO LEVY AN EMPLOYEE’S WAGES?

What to do when the IRS wants to levy your wages. IRS Misconception #5:  I’m in This Alone and No One Can Help Me

Not true. You might be shocked to learn that more than 20 million Americans owe some amount of back taxes. According to the most recent data from the IRS, Americans owed over $114 billion in back taxes, penalties, and interest in 2020. And, as we’ve all learned by now, where there’s money, scam artists aren’t far behind. In recent years, a number of companies have appeared who claim to help taxpayers resolve back tax debt. It’s disturbing, but true, that the majority have been proven to be scammers and fraudulent companies. They know you’re worried and stressed, and that vulnerability makes it easy for them to prey on you. Some charge as much as $5,000 just to “look into” your situation. Often, they take months to come back with disappointing news – they can’t really help you. Our belief – based on the many reports we’ve read over the years, and what the Better Business Bureau has reported, is that many of these companies are fraudulent.

It makes you skeptical of the entire process. It’s why we never take a case unless we are fully confident it will end in the absolute best possible outcome for you. We’re the good guys and that’s one of the ways we prove it to you. We’ve removed the risk the shady operators have made you wary of. You’re right to be skeptical, we understand. IRS Misconception #6:  My Accountant Is The Best Person To Help Me Get Tax Relief

Unfortunately, it’s just not true. There really isn’t any opportunity to obtain any level of education on the methods used by the IRS. There’s no concise guide to taxpayers’ rights (at least none that “regular” people can understand), and very few people – in any profession – know how to achieve real tax relief. It’s rare to find an accountant who knows how to communicate with the IRS Collection Division. Accountants are not required to take, nor is there a course in any academic institution that teaches anyone how to navigate the IRS Collections’ process. So, while your accountant knows a lot about preparing taxes, he or she probably knows very little about how to get closure on your past tax debts. It may seem odd, but the IRS is a highly specialized agency and the only people who know its inner workings are people who have been employed by the IRS. Then, to have gained the specialized knowledge to help resolve tax issues they must have worked in the collection department – Specialized knowledge inside a specialized agency. You can see why we hire retired IRS Revenue Officers. They know, and can do, what virtually no one else can. When they use that knowledge and know-how to your advantage, you get results. Period. Proven. Over and over again.

IRS Misconception #7:  If I Avoid the IRS, They’ll Go Away

Don’t do it! If you avoid the IRS, your situation will only get worse. Until they collect every dime and dollar you owe, or you return their calls and talk to them (or engage us to do that on your behalf), they’ll continue to escalate their collection efforts. They will use everything in their arsenal to collect what you owe, including levies, seizures and more. And, it happens fast. You want to avoid this scenario, believe us. Unless you’ve notified them otherwise, the IRS assumes you can pay your tax debt and they’ll continue to pursue you UNTIL you properly notify them you can’t afford to pay. If you prove to the IRS you can’t afford to pay, they can relieve you of payment of most of your debt and put you back into good standing. No more chasing. No more phone calls, letters and threats. NO surprise visits to your home or work. They will leave you alone. Avoiding the IRS is the worst thing you can do. They won’t go away and your debt will mount quickly as they add penalties and interest. IRS Misconception #8: I Should Hire One of Tax Relief Companies that Advertise on TV

Don’t do it. We hate to have to say it, but there is just no way around it: The tax resolution industry is full of crooks and bad actors. They prey on your fear and vulnerability. They sound official and try and put your mind at ease – they know you’re longing for someone to just take this problem off your shoulders. Beware…There have been numerous news stories about, and government prosecutions of, companies that claim to provide tax relief but actually do nothing at all except take your money. It’s sad, it’s astonishing, but it’s true. It infuriates us that these companies cheat people – intentionally – knowing you’re vulnerable, and scared of the IRS.

What they’re doing is committing fraud, plain and simple. There’s no way (and really no reason) to sugarcoat it. There are some more scrupulous companies, but most charge hefty fees, and never seem to arrive at a result. Many of them talk a good game, but a game it is. They often make matters much worse by playing hide and seek with the IRS. They situate themselves in the middle of the action (between the IRS and the taxpayer, without giving much information), which is a point of aggravation for the IRS, and one you want to avoid being part of. The IRS respects – and responds to – direct and proper communication on their terms. They are also well aware of these bad actors and are not happy about their behavior. Associating with one of these companies is not a situation you want to risk putting yourself in.

IRS Misconception #9: My Situation is Different

Not true. Almost everyone we talk to thinks their situation is unique. “That’s great for that other person, but my situation is different. I’m pretty sure Taxpayers Clinic can’t help me. I owe taxes because…” There is no place on the IRS form asking for any information about WHY you owe. Did you read that carefully? It doesn’t matter WHY you owe taxes. If you can’t pay, you can get relief. There is zero subjectivity in the process. IRS representatives are not allowed to exert any judgment about your personal financial decisions. It just does not factor in. So no matter how you got there, the only question to be asked and answered is whether or not you can afford to pay what you owe. Period. End of story.

IRS Back Taxes Misconceptions (Part 1)

9 SHOCKING MISCONCEPTIONS ABOUT YOUR IRS BACK TAXES

If you owe the IRS back taxes, chances are you’re stressed, uncertain where to turn for help and worried about your future. You might feel like you’ve been backed into a corner. In recent years, the economy has shifted radically, in ways many of us never saw coming. Sadly, it’s become all too easy – and too common – for good people to fall into trouble or out of luck. Please, don’t feel like you’ve done something wrong, or that you’re alone out there.

Many times, it’s not your fault.

Millions of Americans owe back taxes – it’s an epidemic. Fortunately, there’s a cure. First, let’s put your mind at ease and give you some perspective on what you’re dealing with. Our job is revealing the little-known truths about owing the IRS.

We will explain how you can put your IRS problems and worries behind you, and get back to living a normal life. A life where you’re no longer “looking over your shoulder,” feeling hunted by the taxman. Should you have any questions, we’re available and easy to reach.

IRS Misconception #1:  The IRS Will Never Stop Trying To Collect My Tax Debt

This may be hard to wrap your mind around, but the IRS has a special program if you can’t pay your full tax liability or doing so creates a financial hardship – it’s called “an Offer in Compromise ”, or OIC. Once you are granted OIC status, the IRS will take no further action to collect your debt and you’re under no obligation to pay as long as you file and pay all future taxes on time. Your past debt will be “dismissed,” and you will be left in peace.

However, to keep your file in OIC status, you must be up to date on your current year’s taxes, with no exceptions. Failure to pay raises a red flag that will cause the IRS to reopen your closed file and (perhaps aggressively) attempt collection.

Are you eligible for an Offer in Compromise?

To obtain an Offer in Compromise, you must:

  • Meet IRS requirements which prove you don’t have the money to pay all your tax debt
  • Fill out ALL the necessary and relevant IRS forms
  • Know the exact language to use when communicating with the IRS

The reality is simple: The only way you can learn what IRS agents know is by moving up the ladder in the IRS collection department. Oddly enough, there is no opportunity for advanced tax education on any level, at any institution, anywhere in the United States that teaches you how to work with the IRS. However, IRS Revenue Officers have specialized knowledge that they are permitted to use as retirees. These retired IRS Revenue Officers are experts at negotiating and obtaining an Offer in Compromise for most people who owe back taxes – of any amount – large or small. Once your offer has been accepted, you can stop worrying about paying your entire past tax debt and pay only the offer settlement amount. Sometimes it’s just a fraction of what you really owed. It’s a huge relief, a real weight lifted off your shoulders.

IRS Misconception #2: I Only Get One Payment Arrangement With The IRS. I Have to Accept My Current Situation

Not true. In fact, you have clear and certain rights with the IRS. One of these rights is your ability to request changes to any existing arrangement. If you currently have an arrangement with the IRS, you can apply to change that arrangement. At any time, for any reason. Changing your arrangement, or having your offer in compromise file submitted properly is the surest path to settling tax debts you’re unable or can’t afford to pay. In fact, if your financial circumstances changed right this instant, you could call the IRS and request a different resolution.

For example, say you arranged a payment plan with the IRS yesterday. Today you come into work only to be handed a pink slip and told “thanks and good luck.” You can call the IRS right then and there and secure a more affordable payment plan. Ideally, we’d prepare and file an Offer in Compromise on your behalf. Once it is accepted that means you DO NOT HAVE TO PAY THE FULL AMOUNT OF WHAT YOU OWE.

And here’s another shocker: The IRS will agree in virtually every instance where you qualify, if you know exactly what to present and how to present it. IRS Misconception #3: The IRS Doesn’t Waive Back Taxes, Ever.

But as the old saying goes, you can’t get blood from a stone. And, they don’t want to waste their effort attempting to do so. If you truly can’t pay, they want to turn their attention elsewhere (what a huge relief for you, right?)

Hear this: the IRS is NOT out to destroy you financially. That’s why there are very clear and specific procedures for evaluating who can pay and who can’t. For those who can, they will work out a (reasonable) payment agreement. For those who can’t, the IRS will work with us to negotiate and obtain an Offer in Compromise for you. Note: If you have a payment agreement in place currently that you can’t afford to pay, we can help you negotiate a lower payment, or perhaps no payment at all.
